If a health care mandate is unconstitutional, why can the government require us to have car insurance? keep ..?
… reading because I am playing the devils advocate here. I have been reading a lot of b.s. that goes like this.
“…for a long time the government has required us to purchase car insurance so it can also require health insurance.” I have found 3 glaring errors in this argument. Do you know what they are? If you are a liberal, can tell us why car insurance mandates set a precedent for Health insurance mandates?
My bottom line is this – there is no precedent from auto insurance laws to require people to insure their own health. I will explain this with an edit after giving you guys time to answer.
2. You are only required to have car insurance if you drive on a public road. It is up to you whether or not you drive on public roads so your freedom, while limited is not absolutely curtailed by a mandate to carry car insurance. The health insurance mandate that congress is considering is not optional because it will be required if your live in the USA to have the insurance. You cannot opt out like car insurance by choosing not to drive. The only way to opt out is to move away, drop below the poverty line, or die. Most Americans do not consider any of these a good option.
3. Car insurance is required because a car has the potential to do bodily harm and property damage to someone else. There are no car insurance laws requiring you to insure your own car against damage, just the damage you may potentially do to someone else. So therefore the comparison completely breaks down. The current Health care legislation is requiring you to insure your own health, not any one else.
1. There is no FEDERAL law requiring the purchase of Car insurance. It is a matter that has always been left completely to the States. If you have ever gotten a ticket for driving without insurance, it was a State law that you violated, not a Federal law.

So at this point no one should be offering the Government requires Car insurance argument any more to support mandatory health insurance.

Nobody has to drive a car.
You have the choice to own a car or not. You have no choice when it comes to your health.

Yes. Because you do not have to drive a motor vehicle. If you choose to exercise the privilege of operating a motor vehicle, you imply consent to obey all the applicable laws associated with such operation in the state which licensed you.
With auto insurance you are covering other potential victims – not yourself – with mandated insurance. Also the IRS is not involved in enforcement.
They don’t require you to get car insurance. As it is not required for you to drive a car on roads built with tax dollars.
Government should not ever require it’s citizens to purchase a product or service from private corporations. But if you want to drive on the roads, you gotta play by the rules. Just like the government can’t tell you not to be drunk… until you get behind the wheel of that car.
They only mandate you protect the other guy.And driving is a privelege, not a right.Health is a responsibility, not a right.

The difference is not subtle.
When was the last time a blind person drove a car legally. Lol
People who’s licence was revoked permanently shouldn’t pay for insurance.
Kids under the driving age don’t require insurance.
But in THIS case government is forcing us to do the equivalent of paying for SOMEONE ELSE’s car insurance…
A health care mandate is like a tax on breathing, a tax on simply being alive. You had no choice in that matter.
Owning a car is a choice. You really arent mandated to buy insurance for it unless you intend to drive it on public roads. And when I’m taking my car out on public roads, my insurance is meant to protect other people on the road, not just me. When I take my car out on the road, Im taking a chance of hurting someone. But when it comes to health care insurance, my breathing, the fact that I simply exist, isnt hurting anyone.
Cars are a privilege. And a great source of income for uncle sam.
They don’t require you to buy a car in the first place, if you do you need insurance for simple reasons, but health care is different because maybe i don’t want it in the first place, and i am not buying it, they will have to arrest me along with millions, let the reveloution begin
Pffftt… Car insurance… And we pay EXTRA money to protect us from people who don’t, you guessed it, have car insurance. :-/ Speaking of car insurance… aren’t they the people you pay to repair your car when it gets damaged? You pay them thousands and thousands of dollars? Then you get $200 worth of damage on your car they try to refuse to pay? Yeah, that’s them. Health insurance is headed the same way.

You do not have to drive. It is a choice. If you decide to drive on public highways with other citizens you have to have insurance to pay for any damages you cause due to an accident which is determined to be your fault.
car insurance is required by states not the federal government.
You only have to purchase car insurance if you own and drive a car.
The car insurance required only protects the other cars on the road, not your
own car unless you wish to voluntarily protect your own car. It is your decision.

Auto insurance is only required of those who drive/own cars. If a person owns a car he/she should either be able to prove that he/she is capable of taking care of any automotive accidents or be able to pay for his/her auto insurance. Health insurance is another thing altogether. There are people in this country that can not afford to turn their water on in their homes or do not have a place to stay and yet the government believes that we should all be able to afford some type of health insurance. That is rediculous! Have a great week.

Driving an auto is not a right. It ia a privilege. When you buy auto insurance, you are only required to buy liability, so in fact, you are buying it to protect other drivers from your mistake. Auto insurance is also a state ssue. It is not mandated by the federal government.
On the other hand, the federal government telling me I have to buy something I may not want or need at the time is a whole different can of worms, and as far as I’m concerned, a dog that won’t hunt.
You are correct that car insurance is more of a policy to make whole someone who sustains damage or injury by your car. State mandates vary from “no fault”, to bonding and liability coverages. Because driving is optional and living and breathing is not the comparisons are really stretching the argument.
